By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to StartMob.
StartMob is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
The StoryPad app stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the StoryPad app won’t work properly or at all.
The app does use third-party services that declare their Terms and Conditions.

You should be aware that there are certain things that StartMob will not take responsibility for. Some app features will require the app to have an active internet connection. The connection may be Wi-Fi or provided by your mobile operator, but StartMob cannot be held responsible for the app not working to its full potential if you do not have Wi-Fi access and do not have your data. the allowance remains.
If you are using the app outside of a Wi-Fi area, you should be aware that the terms of the agreement with your mobile operator will still apply. As a result, your mobile operator may charge you data charges for the duration of your connection when accessing the application, or other third-party charges. When using the App, you are responsible for any such charges, including roaming data charges if you use the App outside of your home territory (i.e. region or country) without turning off roaming data. If you are not the bill payer for the device on which you are using the app, please note that we assume that you have received permission from the bill payer to use the app.
Likewise, StartMob cannot always take responsibility for how you use the app, i.e. you need to make sure that your device remains charged - if it runs out of battery and you cannot turn it on in order to use the service , StartMob cannot accept responsibility.
Regarding StartMob's liability for your use of the app, when you use the app, it is important to remember that while we strive to keep it up to date and correct, we rely on third parties to provide information to us so that we can make it available to you. StartMob is not responsible for any damages, direct or indirect, that you incur as a result of relying entirely on this functionality of the application.
At some point, we may want to update the application. The app is currently available for Android - system requirements (and any additional systems we choose to extend the app's availability to) may change and you'll need to download updates if you want to continue using the app. StartMob does not promise that it will always update the application to suit you and/or work with the version of Android installed on your device. However, you promise to always accept app updates when they are offered to you. We may also terminate the provision of the application and terminate its use at any time without notifying you of the termination. Unless we notify you otherwise, upon termination, (a) the rights and licenses granted to you under these terms will terminate; (b) you must stop using the application and (if necessary) remove it from your device.
Requirements for use
Make sure your account details are accurate and that you keep your accounts secure. You are responsible for your accounts and any activity on them. Also, you must be at least 13 years old to use the app.
When you download content in the app, it still belongs to you. However, you give us permission to use it in the ways necessary to provide, improve, promote and protect our services. For example, when you upload a photo, you give us the right to keep it displayed. We may also promote or display your content, but you can opt-out if you do not want us to do so.
You are responsible for the content you post and warrant that it can be used. Please abide by our rules and do not do anything illegal with the services. Also keep in mind that anything you upload may be public.
Only use content that you are allowed to use. You represent and warrant that you own all rights to your User Content or otherwise have (and will continue to have) all the rights and permissions necessary to use, share, display, transmit and license your User Content through the Services and in the manner prescribed by in this Agreement. If we use your User Content in the ways described in this Agreement, you represent and warrant that such use will not or infringe the rights of any third party, including, without limitation, any copyright, trademark, privacy rights, rights of publicity, contract rights, trade secrets or any other intellectual property or proprietary rights. In addition, the contents of the Services may be protected by intellectual property rights, trade secrets, or other rights of others. Please do not copy, download, upload or share content unless you have the right to do so.
You represent and warrant that your use of the Services complies with applicable laws, including, but not limited to, applicable export or import controls, rules and sanctions.
Your published materials are under your responsibility. Your content may have consumers (“End Users”). You understand and agree that (a) your Content and your End Users are your responsibility; (b) you are solely responsible for providing products, services and support to your End Users; (c) you are solely responsible for complying with any laws or regulations relating to your Content and/or your End Users; and (d) your ability to create, share or otherwise manage your Content may be limited to the extent that your Content includes Licensed Content. We are not responsible for and will not provide you with any legal advice regarding your Content or your End Users. This does not limit or affect any liability we may have to you separately for any breach of other provisions of this Agreement.
Acceptable Use Policy
Below are some guidelines on what you should not do with the Services.
Do not investigate, scan or test the vulnerability of any system or network.
Do not use our Services to send spam, emails that violate laws, emails to people who have not given explicit consent (if such consent is required), or other unsolicited communications (bulk or otherwise), promotions or advertisements. Please note that we reserve the right to determine what constitutes spam.
Do not submit altered, misleading or false source-identifying information (including any misleading or incorrect names, email addresses, subject lines), including but not limited to phishing or spoofing.
Do not do anything that is false, fraudulent, inaccurate or misleading.
Do not impersonate any other person, company or organization.
Do not engage in misleading or unethical marketing or advertising.
Do not promote or advertise products or services other than your own.
Do not infringe or misappropriate anyone's copyrights, trademarks or other intellectual property rights.
Do not violate anyone's privacy or right of publicity.
Do not threaten, harass or insult people.
Don't incite violence.
Do not post sexually explicit or obscene material.
Do not condone or encourage self-mutilation.
Do not condone or promote violence against any person or group based on race, ethnicity, nationality, religion, gender, gender identity, sexual preference, age, or disability.
Do not violate any laws using the Services, including, but not limited to, all local laws regarding online conduct and acceptable content.
If we, in our sole discretion, conclude that you have misused the Services, we may take action against your Account or your Content. We strive to provide fair results, but in all cases we reserve the right to remove any content or suspend or terminate your Account or your Content without refunding any amounts paid for the Services, without any liability or notice to you in any time.
Changes to these Terms
We may update our Terms from time to time. As such, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms on this page.
